In the context of global push to counter migrant smuggling, in November 2023 European Commission presented a new anti-smuggling directive proposal, replacing 2002 Facilitators' Package. this article, we critically analyse two key elements proposal and reflect on their implications human mobility Central Mediterranean. First, explore proposal's limited scope, which frames facilitation movement primarily as criminal offence performed by smuggling networks alone. Second, assess introduction financial or material benefit constitutive element crime smuggling. We then evaluate these components light recent developments criminalization sea rescue operations people move along Mediterranean route. Finally, raise concerns over directive's potential impact within Euro-Mediterranean region. While it may reduce likelihood efforts from being labelled will allow for continued prosecution who pilot boats no benefit, an effort save lives those others.
