Custody cases involving transgender and gender‐expansive youth: Building toward best practices using interdisciplinary and child‐centered perspectives

Abstract
There
is
an
increasing
number
of
high‐conflict
custody
cases
involving
transgender
and
gender
expansive
(TGE)
youth
within
family
courts.
The
current
sociopolitical
climate,
giving
rise
to
unprecedented
amount
anti‐transgender
legislation,
adds
further
complexity
decision‐making
creates
a
contentious
unpredictable
climate
for
TGE
affirming
parents
in
court.
Although
researchers
health,
child
development,
well‐being
have
generated
robust
body
evidence
supporting
the
importance
community
youth,
there
remains
disconnect
between
evidence‐based
best
practices
actual
practice
Courts
are
frequently
diverted
by
question
whether
TGE,
or
who
“to
blame”
child's
identity,
rather
than
seeking
determine
which
parent
better
able
meet
needs
whole
child—including,
but
not
limited
to,
related
identity
expression.
Contested
litigation
provides
opportunity
courts
prevent
harm
promote
families
facilitating
access
care,
education,
support,
can
more
effective
approaches
complex
establish
post‐separation
success
families.
This
paper
proposes
mental
map
that
leverages
interdisciplinary
research
on
development
expression
coupled
with
use
child‐centered
approach,

on
SGM
youth
homelessness

Resilience
Portfolio
model.

Social
Science
Citation
Index,
locating
41
empirical
articles
strengths
resilience
among
population.
Through
a
careful
data
extraction
process,
identified
across
all
three
domains.
Important
regulatory
included
psychological
endurance,
self-efficacy,
acceptance.
Among
interpersonal
strengths,
most
widely
endorsed
source
of
social
support
was
identity-affirming
"chosen
families."
Informal
informational
networks
tailored
comprehensive
services
were
key
youth's
broader
ecologies.

meaning
by
expressing
authentic
identities,
maintaining
hope,
resisting
oppression,
defining
their
own
beliefs.
Overall,

religious
beliefs
can
motivate
family
rejection
among
sexual
and
gender
minorities
(SGMs),
ultimately
harming
their
mental
health,
researchers
have
not
examined
the
direct
link
between
religiously
based
expectations
health.

Based
Family
Expectations
Scale.
