Area-based management tools (ABMTs) are crucial for conserving marine biodiversity in areas beyond national jurisdiction (ABNJ). The BBNJ Agreement establishes a global framework the protection of critical ocean through implementing ABMTs. While this agreement provides framework, its success relies on individual states’ participation and dedication. China has signed Agreement, recognizing essential role coordinating international efforts to implement This article argues that possesses capabilities advance ABMTs ABNJ, drawing from established policies, institutional collaboration, extensive experience managing domestic protected (MPAs). With the proliferation of human activities, a series marine ecological and environmental problems have arisen. Judicial application is important to test legislative achievements, explore judicial difficulties, examine compliance with law.
